Clark County District Court Judge Darvin Zimmerman, 70, stated he was taking time off after being caught on camera during a Zoom meeting making comments about Kevin Peterson Jr. and Black suspects in general.
Last week between court cases, Judge Zimmerman spoke to another court official while the Zoom meeting was running. During his conversation, he demonstrated judicial and racial bias while disparaging defendants and their family members. The Oregonian released a video of his comments on Monday after a YouTube video was removed on Saturday.
The Barrar Law Firm, one of the largest criminal defense firms in Western Washington, called for Zimmerman’s resignation following the broadcast. Moments later, the other five judges at Clark County District Court condemned Zimmerman’s comment, stating, “racial bias displayed by a judge is unacceptable, unethical, unjust and cannot be tolerated.”
By morning, county prosecutors and defense lawyers alike were filing motions to disqualify Zimmerman on cases he was presiding over. In a story by Oregon Public Broadcasting, Clark County Prosecutor Tony Golik stated, “We’re not indicating that the prosecutor’s office feels like we would necessarily get an unfair ruling. We’re worried more about people that are accused.”
During the Zoom meeting where Zimmerman talks to another unnamed court official, he stated that Kevin Peterson, Jr. had a “death wish” and that he was “so dumb” for fearing a lifetime in jail if he didn’t cooperate with a regional task force. Peterson Jr., a 21-year-old Black man, was shot by police in October during an alleged drug bust. Security camera video and phone records call into question police actions during the attempted arrest of Peterson Jr.
In a further twist, Judge Zimmerman’s son, Erik Zimmerman, was one of the Clark County Sheriff deputies present during the attempted arrest of Peterson Jr. As the suspect ran away from police, the younger Zimmerman was one of three deputies who shot at Peterson Jr.
During the Zoom meeting, Judge Zimmerman suggested that Peterson Jr. family was trying to capitalize on his death, saying, “he wakes up with dollar signs in his eyes and George Floyd’s attorneys.”
Several defense attorneys and public defenders who have petitioned Judge Zimmerman have come forward this week with questions on his conduct and his attitudes towards non-English speaking defendants.
[SEATTLE] – (MTN) Noriko Nasu was with her boyfriend in the International District of Seattle when a random man attacked her with a sock laden with a rock. He beat her so badly in what appeared to be a random attack she is now suffering from shattered teeth and multiple facial fractures. In a report with KOMO news, Michael Poffenbarger reported he was also struck in the head. “I truly believe he was trying to kill us,” he stated. On Thursday, Seattle Police arrested 41 years old Sean Holdip for the crime. He is being held on unspecified charges as prosecutors mull bias crime charges.
A review of records shows that Holdip has a lengthy history of bizarre and violent behavior spanning across the United States. Holdip graduated from Murry Bergtraum High School for Business Careers in 1997, a public college preparatory secondary school in Lower Manhattan. His promising start brought him to the New York City Fire Department where he was employed as an EMT.
In 2010, the first complaint against Holdip was filed by a coworker. According to the New York Post and public court records, the coworker claimed that Holdip had swung a broom handle at them aggressively because he had insulted his driving ability. There was a misogynist incident with a female coworker and then in 2012, he was accused of pulling a knife on another coworker. In 2014 he told a judge he was going to use the knife to, “clean his nails.” While the case against him dragged through the system for three years, Holdip was assigned to work in a supply room and not interact with patients. He was fired in September 2014 and exhausted his appeals in February 2015.
Public records indicated Holdip has moved between New York and California. His current address is indicated to be in New York, and there is no record of him having an address in Washington.
Nasu is home and recovering from her injuries. Poffenbarger reports he brandished a pocket knife in an effort to deter Holdip, but that he kept coming. Good Samaritans stepped in and broke up the assault, and Holdip fled. There has been a significant increase of violent crime bias attacks against minorities in Seattle through 2020, with a significant increase against people of Asian descent.
Abusive Head Trauma replaced the term ‘shaken baby syndrome’ a decade ago, yet the questionable medical diagnosis is still convicting people
Over 45 years ago, a group of doctors concluded that a triad of medical conditions, bleeding around the brain, retinal hemorrhages, and brain damage, could only be caused by an adult violently shaking a baby. By the 1990s the science was being called into question even as diagnosis and convictions exploded. Today, hundreds of convictions for ‘shaken baby syndrome’ are under review, with court decisions being reversed. What doctors through was a constellation of symptoms that could only happen by shaking an infant or toddler, is now understood to happen due to a variety of medical conditions.
Further research has indicated that not only have hundreds been falsely accused over the past four decades, but parents who are poor, single-parent, ESL, and BIPOC were far more likely to be accused of AHT than wealthy two-parent households. The data indicated that there was no possible explanation beyond bias to account for these differences. This bias prevented early detection of potential abuse, as victims of AHT tend to have had previous visits to an emergency room for less severe injuries, which should have raised red flags. Worse, if doctors, nurses, or social workers made a predetermination of AHT, they would cut off the parents in any medical decision-making, including blocking tests and procedures that would have proven innocence, and helped with better treatment.
