BREAKING: Bail set for Tacoma police officers charged in murder of Manuel “Manny” Ellis

[TACOMA] – (MTN) Bail was set for the 3 officers who were arrested yesterday and criminally charged due to their involvement in the death of Manuel “Manny” Ellis on March 3, 2020. All three defendants pled not guilty and had bail set at $100,000 each. Christopher Burbank and Matthew Collins are charged with second-degree murder and Timothy Rankine is charged with first-degree manslaughter.

Prosecutors argued for bail of $1,000,000 for all three defendants while the lawyers representing all defendants asked for personal recognizance. Additional conditions of the three officers include surrendering their passport, no contact with their co-defendants, the Ellis family, or witnesses, surrender all weapons, and travel restrictions.

It was revealed in court that Collins has since moved to Oregon, despite still drawing his salary with the Tacoma Police Department of $116,109 annually. Collins’ attorney stated he would still need to be able to travel to his job in Oregon, but it wasn’t disclosed what kind of work he is doing, or if it was in law enforcement. Collins was given permission to travel within the county of residence in Oregon and the adjoining counties, and to and from the court or to see his attorney in Washington.

Rankine’s attorney admonished the court’s bail request for $1,000,000 and called the state’s request “false information” when saying this was comparative to other charges. The attorney also argued because he was a veteran with two Purple Hearts, was “superhuman,” and only arrived as a backup officer, he should not have been charged. Rankie lives in Bothell, Washington, according to his attorney.

All three defendants were arrested yesterday after Washington State Attorney General Bob Ferguson announced the charges against the trio in the death of Manuel “Manny” Ellis. The state AG stated that Collins and Burbank could face 10 to 18 years in prison while Rankine could face 6.5 to 8.5 years.

On March 3, 2020, Ellis was returning from a trip to 7-Eleven when he started speaking to officers in a city of Tacoma police cruiser. According to eyewitnesses, one of the officers violently threw open their car door, striking Ellis, who was restrained with a knee to the neck. He was tasered, hobbled, and had a spit hood placed on his head and stopped breathing shortly thereafter. Medics did CPR for 40 minutes before Ellis was declared dead. His last recorded words from a Ring security camera across the street were, “I can’t breathe, sir.”

In events eerily similar to the death of George Floyd in Minneapolis, the Pierce County Medical Examiner labeled Ellis’ death a homicide caused by hypoxia and physical restraint. Contributing factors included an enlarged heart and methamphetamine intoxication. Police investigators labeled this a case of “excited delirium,” which is not an accepted medical diagnosis by the American Medical Association, the American Psychiatric Association, and is not part of the DSM-V.

The case received little attention for 3 months, and under Washington I-940, the investigation was moved to the Pierce County Sheriff Department. A week before the final report was to be released, it was revealed a Pierce County Sheriff deputy participated in the restraint of Ellis, in a potential violation of I-940. After the revelation, several witnesses came forward with cellphone video of the incident that disputed Tacoma Police and Pierce County Sheriff’s depiction of the events that led to Ellis’ death.

The family of Ellis fought for a meeting with Governor Jay Inslee to have the state take over the criminal investigation. On December 31, 2020, a nearly 2,000-page report was released by the Washington State Patrol, that raised serious questions about the conduct of officers, the veracity of their reports on the incident, and their conduct toward Ellis.

A decision on the case was supposed to come by March 2021, but it was further revealed that a Washington State Patrol officer was also present during the incident with Ellis, creating a new conflict of interest. The State Police report received 2 months of further review, and the charges were announced on May 27, 2021, almost a year from the day Geroge Floyd in Minneapolis was murdered by Derek Chauvin, who was convicted of second-degree murder in that case.

All 3 defendants appeared before the court wearing Pierce County Jail jumpsuits and appeared unemotional during the hearings. It is important to note that video quality was poor, and there were significant audio issues during Burbank’s hearing and the start of Collin’s hearing. The defendants have been ordered to return to court on June 24.

To date, 4 officers in Washington state have been criminally charged under I-940. The first was former police officer Jeff Nelson of Auburn, Washington. Nelson was arraigned in August 2020 for the slaying of Jesse Sarey, who was having a mental health crisis. In that case, Nelson was permitted to appear before the court on a summons and King County prosecutors asked for no bail. The judge set bail at $500,000 after an impassioned plea by Sarey’s foster mother, Elaine Simons. Nelson is still awaiting trial in that case and continues to draw his salary with the Auburn Police Department.

BREAKING: Governor Inslee announces all counties back to Phase 3 May 18, full opening on June 30

[OLYMPIA] – (MTN) Governor Jay Inslee has announced that the state will move all counties to Phase 3 on Tuesday, May 18, and will fully reopen on June 30, in a press conference today, essentially scraping the Safe Washington reopening plan implemented in March. The state mask mandate has also been lifted effective immediately for all vaccinated individuals both indoors and out, with the exception of hospitals, jails and prisons, public transportation, homeless shelters, and other areas where people congregate in tight quarters.

Gov. Inslee indicated that the state would get to a full reopening faster if more than 70% of residents over 16-years-old get at least their first COVID vaccine dose before June 30. The governor explained that the 70% requirement did not include 12 to 15-year-olds because the state opened up vaccination to the younger age group only yesterday.

The June 30 date has one exception. If statewide ICU utilization exceeds 90% and hospitals start canceling elective surgery due to the volume of COVID patients, the full reopening would be delayed, or if after June 30, the state could implement a pause in the plan. Currently, statewide ICU utilization is at 82%, while Pierce County was at 88.6% yesterday. One hospital in Bellingham was pausing elective surgery due to COVID and the unprecedented birth of 18 babies in 36 hours. Resources have been stretched thin at the facility, with officials saying last weekend was the busiest in its history.

The governor indicated that businesses could require proof of vaccination to gain entry, but that it is up to individual business owners. In a question asked to Gov. Inslee about creating an official vaccination passport, he stated that officials have no plans to implement an official document.

Lacy Fehrenbach said people can get a copy of their vaccine records by visiting MyIR and registering on the website. She added that the website requires registration and authentication, so it can’t be used as a tool to provide immediate access. Fehrenbach also suggested that have a photo of the card would be acceptable. Although not expressly stated, front and back would be ideal. Several attempts to visit the website after the press conference were thwarted due to traffic volume.

The governor also stated that local county health officials could move to a lower phase if they determine they need to keep stricter requirements starting on May 18. Pierce County continues to have some of the worst statistics in the state, and a low vaccination rate. Under the now-defunct Healthy Washington plan, Pierce County would be in Phase 1.

For those thinking about creating a fake vaccination card, the FBI issued a statement last week that doing so is a felony because the vaccination card has an official government seal on it. The penalty is a fine of up to $5000 for each violation and up to 5 years in prison.

Breaking: New information leads Federal Way Police to seek a person of interest in the death of Royal’lee Wallace

[FEDERAL WAY] – (MTN) Federal Way Police are seeking a person of interest in the shooting death of 8-year-old Royal’lee Wallace after her father, Cherith Wallace, was released from King County Jail and all charges against him were dropped.

On Sunday, Royal’lee Wallace was shot after a bullet traveled through three walls in the apartment that she lived in. Federal Way Police responded to a call at St. Francis Hospital where 8-year-old Royal’lee had been taken to the emergency department in a private vehicle. She was transferred to Harborview Medical Center in critical condition and placed on life support, before succumbing to her injuries.

Cherith Wallace, the father of Royal’lee was with her at the hospital and was arrested after investigators concluded the gunshot came from inside the apartment. Wallace attended a vigil for his daughter yesterday in West Seattle and stated he doesn’t own a gun, and no gun was in the apartment during the investigation.

Kurt Schwan, Commander in the Federal Way Police Department said in a statement, “Working closely with the King County Prosecutor’s Office, probable cause was developed to arrest the father on the afternoon of the shooting based on the initial statement he provided about being alone in his apartment with his child when she was shot.”

“Evidence revealed that a firearm was discharged from inside the apartment unit and the bullet struck the child after passing through three walls.”

According to Schwan, Wallace initially told investigators he was alone, but after his arrest and further questioning, Wallace revealed two other individuals were in the apartment at the time of the shooting.

In his statement, Schwan continued, “Detectives have discovered additional information that indicates two other individuals were in the apartment with the father when the shooting occurred.”

“After further interviews with the father and one of the other two subjects allegedly in the apartment when the shooting occurred, the father was released and the investigation shifted to locating the person who is now believed to have fired the fatal shot.”

Schwan says that it was Cherith Wallace’s initial statement that resulted in his arrest. Due to the ongoing investigation, no further information was provided on whether the elder Wallace was threatened by one of the two people in the apartment. We asked Schwan if a firearm was secured at the scene and if a firearm residue test was made on the elder Wallace during the initial investigation. Schwan declined to discuss specifics stating the ongoing activity in the case.

The Federal Way Police Department is asking anyone who has information into the murder of Royal’lee Wallace to contact the department at 253-835-2121.

Updated: Suspect in Bothell stabbing arrested, no comment on potential anti-Asian hate crime from police

Editor Note April 29, 2021, 10:40 AM: A previous version of this story identified Williams as a former real estate agent. That was in error. The story has been updated.

[SEATTLE] – (MTN) Ian Patrick Williams of Bothell, was booked into King County Jail on April 26 for investigation of homicide and as a suspect in the stabbing death of a 29-year-old Asian man in Bothell. Williams is being held without bail and a date for arraignment has not been set by King County prosecutors.

According to KIRO news, Williams gave the middle finger to two unidentified Asian men who live in the same apartment building just outside of the entrance. The stabbing victim reportedly said, “what is wrong with you,” and Williams lunged at him with a knife, stabbing him fatally in the heart. Bystanders and police tried in vain to save the victim.

Bothell Police will not say if they are investigating this as a hate crime. Williams was arrested moments after the attack and apparently made no statement to police or bystanders.

Williams is a computer science student in their senior year. He is being held at King County Jail for investigation of second degree murder.

BREAKING: King County COVID metrics exceed requirements to stay in Phase 3

[SEATTLE] – (MTN) The April 26 COVID update from King County Health Department is out and indicates the region no longer qualifies to stay in Phase 3 reopening. In the latest updated King County is reporting 226.0 cases per 100,000, and 5.2 hospitalizations per 100,000. To remain in Phase 3, the county cannot exceed 200 cases per 100,000 and 4.9 hospitalizations.

The numbers back an alarming trend as regional hospitals report a significant increase in COVID patients. Evergreen Hospital in Kirkland, once ground zero for coronavirus in the United States, is reporting 13 patients. Overlake in Bellevue has seen a sharp increase in hospitalizations.

The Washington State Department of Health is reporting 484 hospitalized statewide, the highest level since January. Health officials stated that 40% of hospitalized patients are under 40 years old, and many are sickened by COVID variants. The U.K. variant is replacing the dominant strain. The B.1.1.7 strain is more contagious, virulent, and targets younger adults.

Moving back to Phase 2 will drop restaurant occupancy to 25%, and could result in the closure of movie theaters and sports arenas such as T-Mobile Park.

Snohomish County is also at risk of moving back to Phase 2, and Pierce County, which dropped to Phase 2 on April 16, has seen its metrics get worse.

Experts state that a number of factors are converging to push Washington into the fourth surge of COVD infections. COVID fatigue with social distancing and masks, the reintroduction of in-class teaching, better weather, vaccination hesitancy, and more contagious variants have combined to increase cases across the state.

The next evaluation by the state for if King and Snohomish County will move back to Phase 2 is on May, 2.

SPD officers in Washington, D.C. during January 6 insurrection tentatively identified

[SEATTLE] – (MTN) Researchers have tentatively identified the names and backgrounds of the 6 Seattle police officers who attended the Stop the Steal rally that devolved into an attempt to stop the certification of the 2020 election. Crosscut and our researchers had identified three officers previously.

The six Seattle police officers who allegedly were in Washington, D.C., during the insurrection are:

  • Scotty Bach, Acting Lieutenant through January 6, 2021, now listed as Sergeant
  • Jacob Briskey, Sergeant, K9 Officer
  • Alexander Everett, Officer, previously identified
  • Jason Marchione, Officer, previously identified by Crosscut
  • Caitlin Rochelle, Officer, previously identified 
  • Michael Settle, Vice Unit, Acting Sergeant

SPD listed Scotty Bach as an Acting Police Lieutenant assigned to the Southwest Precinct on October 15, 2020. The data shows he was an Acting Lieutenant through January 6, 2021, and returned to the rank of Sergeant on January 7. Bach is currently under investigation by the OPA for three separate incidents. 

Sergeant Jacob Briskey has been the subject of multiple uses of force complaints, and the city of Seatle had to pay a $269,000 settlement in 2009. In that case, Romelle Bradford sued for being wrongly arrested by Briskey and being “roughed up,” per a Seattle Times report in 2008. The city appealed the finding and ultimately lost the case.

Alexander Everett and Caitlin Rochelle were previously identified as a married couple who went to the January 6 Stop the Steal Rally. Acting Chief Diaz suspended the couple with pay after other officers came forward and reported their activity in Washington, D.C. They were married in December 2020, and it is reported that the trip to hear Donald Trump speak was their honeymoon. 

Jason Marchione is assigned to the South Precinct, and Crosscut previously revealed his attendance at the insurrection on January 6. Marchione and Rochelle are coworkers who work on the same shift. Marchione has had six OPA complaints since he started with SPD in 2017, and almost half of the use of force claims against the officer have been made by Black people. In one case, a Black man claims that Marchione broke the man’s wrist during a “hard takedown.”

Michael Settle is an Acting Police Sergeant Detective specializing in human trafficking. Little is know about Settle beyond a single investigation in 2010. 

A court hearing was initially scheduled for April 2, 2021, to review a temporary injunction, but that hearing was declared moot. 

Andrew Myerberg, the director of the OPA, told NPR, that officers are entitled to their political views, and the investigation will look into whether SPD policy was violated. The OPA added that if the officers committed federal crimes, they would work together with federal investigators.

The OPA has 180 days to release its findings of the officer’s activities to the public. Those results would be published in June and early July of 2021.

EXCLUSIVE: Twitch employee uses work account to spread racist messages during Derek Chauvin verdict

[SEATTLE] – (MTN) An employee of Twitch used their official work account repeatedly to express racist views after the Derek Chauvin verdict on the company’s platform. Twitch is primarily used as a platform to watch others play video games; it has become popular with content creators on many topics, including the arts, music, podcasting, news, and politics. Seattle-based Amazon purchased Twitch in 2014. 

On April 20, 2021, the Twitch channel PTNewsNetwork, headed by Stephen Oatley, covered the Derek Chauvin verdict live. During the stream, a user with the screen name usctrojans117 made multiple comments. The white wrench icon indicates that the user is an employee of Twitch, using their work account.

Among the comments made in the moments after the verdict was read:

“#all_lives_matter”

“oh protests in Chicago where white people get killed EVERY DAY”

“The jury was scared to actually give him a fair trial and fair verdict”

“The rioters are going to riot, [sic] irregardless of the verdict”

“He had enough drugs in his system to kill someone, and one of the side effects of the drugs is restricted breathing, show heart rate, etc.”

“Because people will find any reason to riot and they want the country to implode…and for chaos to ensue and always be present”

“Yeah, let’s see about those ‘peaceful’ protests.”

Malcontent News reached out to Twitch multiple times for comment, but there was no response from their press team. There is no information if Amazon or Twitch is investigating the employee or speaking on behalf of Twitch and Amazon when they wrote these comments using their work account.

Oatley expressed outrage at the verdict and ended his stream.

The idea jurors were intimidated into a guilty verdict has been widely dismissed, including by far-right voices such as Jeannie Pirro of Fox News and local news personality Brandi Kruse. Evidence presented by multiple experts at the trial also rejected the idea that Floyd had lethal amounts of drugs in his system, nor did he display any of the symptoms of someone experiencing an overdose. 

The nation was largely peaceful after the verdict was read, with only a couple of arrests in Seattle and some property destruction in Portland. Outside of the courthouse in Minneapolis and George Floyd Square, celebrations turned into quiet memorials and marches. Right-wing news sites tried to connect pictures of Chitt Week at Ohio State University with riots after the verdict. 

Content creators have the option to allow comments during their stream, who can comment, and when they can comment. Historically, the gaming community was wrestled with misogyny, doxxing, and swatting. Like other social media platforms, Twitch has been grappling with the spread of misinformation and extremist ideology while balancing First Amendment rights. 

16-year-old shot to death in Rainier Beach

[SEATTLE] – (MTN) Seattle police reported a 16-year-old Rainier Beach teen was shot and killed at his family home after answering a knock at the front door.

Around 11:00 p.m., 911 received a call about a shooting in the 9200 block of Waters Avenue South. According to witnesses, the suspect knocked on the door of the residence, and the teen went to answer it. Upon opening the door the suspect shot the victim multiple times and fled on foot.

The victim, who has not been named, was declared dead at the scene.

Acting Seattle Police Chief Adrian Diaz appealed for anyone with information to come forward.

“This is the second juvenile that has been shot in the past month, and we’re just figuring out ways to stop this violence.”

Breaking: Governor Inslee orders criminal investigation into Pierce County Sheriff Ed Troyer

[OLYMPIA] – (MTN) Washington Governor Jay Inslee on Friday ordered the state attorney general office to investigate Pierce County Sheriff Ed Troyer, and his actions on January 27, 2021, involving a Black newspaper carrier.

“The initial reports of these events were very concerning to me, and I had hoped to see some action taken to initiate a criminal investigation at the local level,” Inslee said in a written statement released Friday. “But, to my knowledge, that has not happened almost three months after the incident. So now the state is stepping in. I have spoken to Attorney General Ferguson and his office will conduct this investigation and make the decision whether to initiate prosecution.”

Due to the inaction of Tacoma Police and Pierce County, Gov. Inslee sent a letter to the Criminal Justice Division of Attorney General Bob Ferguson’s office.

On January 27, 2021, Ed Troyer called 911 to report that a man had threatened to kill him and was acting suspiciously driving slowly from house to house. That man was Sedrick Altheimer, who is a newspaper carrier and was delivering papers on his route. Troyer followed Altheimer in his personal vehicle, never identified himself as a law enforcement officer, and reported he had blocked Altheimer’s vehicle.

Troyer repeated multiple times in the 911 call that he was threatened by Altheimer, and reported that he might be attempting to break into garages. Forty-two units from across Pierce County initially responded to the call, with six units arriving.

Troyer walked back his accusations when Tacoma police arrived. Tacoma police did not turn on their recently issued bodycams while talking to Troyer but did activate them when talking to Altheimer. Altheimer was never charged with a crime. When the story broke Troyer expressed surprise that a police report was even created.

The Pierce County Council voted on April 6 to pay former U.S. attorney Brian Moran $50,000 to look into Troyer’s behavior from January 2020 to January 2021 and investigate the incident with Altheimer. However, the investigator has no subpoena power and cannot put people under oath.

The January 2021 incident brought attention to a November 11, 2020, 911 call that Troyer made claiming to have confronted two Black men trying to break into his car and steal his wallet. In that incident when Tacoma police arrive Troyer brushed off the incident, and officers ultimately did not take a report. In March 2021, after the second incident occurred, the officer-involved with the November 11 911 call took an official report into that incident.

Washington state suspends use of Johnson & Johnson COVID vaccine after CDC and FDA advisory

[OLYMPIA] – (MTN) The Center for Disease Control and the Food and Drug Administration recommended pausing the use of the Johnson & Johnson COVID-19 vaccine after reports of rare, but serious complications after vaccination. In response to this recommended pause, the Washington state Department of Health is temporarily suspending the distribution of the J&J vaccine.

The Department of Health released a prepared statement. “Use of that vaccine will be put on hold until we receive further recommendations from our federal partners about how best to move forward. Safety is the highest priority when it comes to all COVID-19 vaccines.”

In the United States, approximately seven million adults have received the Johnson & Johnson vaccine. There were six reports of serious blood clots among women from 18 to 48 years of age, six to 13 days after receiving their injection. The Johnson & Johnson vaccine is a single dose. One patient died, and one other was hospitalized in critical condition.

“The probable cause that we believe may be involved here, that we can speculate, is a similar mechanism that may be going on with other adno viral vector vaccines. This is an immune response that occurs very, very rarely after some people receive the vaccine. That immune response leads to activation of the platelets and these extremely rare blood clots,” said Peter Marks, Director of the FDA Center for Biologics Evaluation and Research.

One of the primary reasons for the pause is to advise the medical community on how to treat this rare side effect. Heparin is frequently used as a treatment for blood clots, but “In this setting, administration of heparin may be dangerous, and alternative treatments need to be given,” both the CDC and FDA advised.

In Washington, almost 150,000 people have received the J&J vaccine, of the four million doses administered to date.

Health officials are recommending that you keep your appointment if you’re scheduled to receive the J&J vaccine unless the provider reschedules. A number of locations are switching to the two-dose Pfizer or Moderna vaccines to keep appointments. Officials in Snohomish County indicated the vaccine appointments at the Angels of the Wind Casino were being canceled.

Anyone who received the J&J vaccine more than a month ago should have little concern for clotting. The CDC advised that if you experience severe headaches, chest pain, leg pain, or difficulty breathing within 30 days of receiving the J&J vaccine, you should see a medical professional promptly, particularly if you were born a biological female and are under 50 years old.

Full disclosure: the author received the Johnson & Johnson vaccine on Saturday, April 10, 2021, and experienced typical side effects of fatigue, sore injection site, chills, and fever.
